View Full Version : Way around the smogmonster!!!!

Im going to do this in the next few weeks for a Toyota 4runner that has lost the ability to control its smog. Anyone see any holes in the logic?

I have a few LLC's now. They are easy to maintain and cost very little to sustain. I want to start one and use the address of a cabin I have that is not in a smog controlled area. Then sell the vehicle to the LLC. If you dont have access to an address (physical not PO box) in a smog control free area find an accountant in one. Sometimes you can register them as your agent and use their address.

In Georgia you have to register the car where you reside. If I move my residence to the cabin then I lose my homstead exemption. Dont want to do that. Plus.. it creates a little bit of a liabiality barrier. If something happens while you are in the business registered vehicle they could only go as far as the vehicle and the LLC in the event of a lawsuit. The registered address has nothing to do with the LLC its just a mailing address.

Any holes???

Any ideas?

We just covered LLCs in my bizlaw class. This idea is so crazy it might just work. Problems I see are the red tape. I will talk to my professor about it. But look into what it takes to start a Corp. in GA I know up hear in Washington it is a PINA. I will look into it and let you know. (Maybe I can get some bonus points in class for helping you start up;) )

People use private trusts and LLCs to obtain Class 3 firearms without CLEO signoff, so it's used to get around regulations that way...but I've got no idea on emissions. I just live in a non-emissions checking area...its easier that way. :)

There used to be an advertisement in "Hemmings" about this from a company based in Montana.
Don't know if it still advertised or not.
Sounded interesting, but never curious enough to check further.
Oklahoma must have some kind of arrangement like this. I see many trucks with Oklahoma tags. Same thing with Maine trailer tags.

I don't know if that would work or not, but I do know of someone here in CA who has everything in a "trust." Can't touch it-but the trust is also in CA...I would consult an attorney to be on the safe side, it would really stink if you put all that effort into something like that only to find out it won't work.

I've spent my fair share of time on the DMV web site this past few weeks, would you believe-they even have a phone # that people can call to rat you out if you have out of state plates on your vehicle, but live in California?

I live in a small enough town that no way I'd get away with it. I had one neighbor who tried-unsuccessfully...took them only a few weeks to nail him.

My Dad also tried to keep his truck ('67 Chevy) with its original reg in South Dakota at my Aunt's house. That lasted only 2 years, he got nailed too, in the driveway of his own house... :( Considering it didn't even need to be smogged, I thought it was a pretty crappy thing for someone to do-he grew up in SD and that old plate meant a lot to him.

I think its pretty sucky that people will actually rat on you-I could NEVER do something like that.

Where in SoCal are you? In San Diego counties, we have some cities that are smog-exempt, etc. Like the desert cities, etc; They even list them on the DMV website, iirc.

Maybe Jefferson was right. He warned of government growing too big and swallowing up freedoms. Annie I told you my thoughts on this matter and visited the wood shed. But if you really look at what has gone on in the past thirty to forty years it is obvious where this is all coming from. I like clean air and I don't condone destruction of the environment. BUt CARB has gone way to far and it is a naked racket. The soviet socialist stat of Kalifornia is bankrupt in every way and the state gets a percentage of the fees from every smog check test. So it is no suprise when I heard that over the next five years or so they intend to test and regulate every internal combustion engine in the state. This will include Diesel pickups Motorcycles boats and stationary engines used on Ag pumps and emergency generators. They are going after heavy trucks too. and every legislator pushing this has a D after their name.

Well, my residence is about as "desert" as one can get, I am east of the Victor Valley area in the Mojave Desert-in an unincorporated area of San Bernardino County. I don't live within a town limit or anything, but still, I get to deal with this garbage.:mad:

No disagreement here...and yes, I have now heard about testing other vehicles, including motorcycles. :rolleyes: How stupid. And here we have these Mexican big-rigs driving through here, belching smoke all over the place!

Lawnmowers are next...:eek:

Ya know when I bought my riding mower a couple of years ago, (I use it for brush clearance) it had to be a CALIFORNIA model?! I could hardly believe it...I'm expecting a technical bulletin any time now about it needing to have a cat installed...:mad:

I have also heard rumors that Ca. may even return to smoging the pre- 74 vehicles again:eek: I know this bill was proposed but dont know if it got any traction. My 72 still has all the oem smog equipt, but the 74:thumbsdown: FAIL.

Someday soon, I will have a second residence out of state, and then-I'll be "legal and the rats can snitch all they like,
Until then, I prefer to avoid giving rats like those any ammo, so to speak...

I think Obama is getting ready to have the 50 states conform to Cal State smog standards. they started with air pumps and gulp valves here (california) in 64 I think. I know my 66 Glad pick up w/ 327 4v has em.

And that is precisely why I've said (more than once) that folks should keep thier smog equipment after they tear it out-can you even begin to imagine...the parts search frenzy this would cause? :eek: Heck, most people toss it out, maybe I should start stocking up! :D Cha-ching!

In CA they have to help you find it, if they can't you get a temporary exemption until the next scheduled smog test.
In '05 they assisted me track down an EGR valve because NONE were available anywhere.

I don't smog my '88, and haven't in years, and have no desire to even try.
It has a cat, an EGR, it is in good tune, and that's good enough for me.

Guessing the state would disagree, since it has no air pump, or CTO's.
The timing is way above the book "spec", etc. etc. etc.
Likely it would pass by the numbers, but of course that wouldn't be good enough:(

I hate to get off-topic here, but our Governator (who I voted for) has an R after his name and what has he done to battle the smog Nazis?! :mad:

I'm just glad I have a '74. It's definitely worth not having the big fender flares. :p

I feel for you folks in California.

I visited the California cheaters link and understand what they are trying to do. They do the same thing here in Georgia. There is no cheaters website but the cops sure do give you a hassle you when your tags and drivers license don't match.

What I was proposing isn't cheating the system. You wouldnt be living in one state and registering YOUR car on another. It would be a business that has a car. They let you use the company car. Like going to a rental car lot and seeing cars from all over the country in their lot. I can drive one of them wherever I want for as long as I want.

In my case, I live in Cobb (emissions county} and will have my business at an address in Gilmer (non-emissions county) so the state on my plate would be the same at my residence, sans county sticker. My situation wouldnt raise too many red flags. I am thinking about buying a new truck. If I were to do this in Wyoming or Montana I wouldnt have to pay sales tax on the vehicle (over 2g in georgia for the truck I want) and no georgia advelorem tax (about $300 a year).

There is a company in Montana that does it all for you. www.mtvehicles.com. They register the business, even go get your plates and send them to you. All for the low price of $1500. The company corporation will set your LLC up and be your agent for $400. With the $1100 dollar difference ill get my own plates pay for a Montana vacation.

I dont know about else where, but here in WA. they just want your money and could really care less other wise...You can buy your way out of the emmisions buy investing like $100-$150.00 on it when it fails and they will give ya a pass...So invest in new mufflers and their ya go, they sign ya off....pitiful isnt it.
